Terms of Service

This is the Terms of Service for using Ko-fi.tools, this governs your use of the service.

1. Introduction

Effective date: May 5, 2025

Welcome to Ko-fi Tools! These Terms of Service (“Terms”) govern your use of our website, widgets, and API (together, the “Service”), operated by Catkin (“we”, “us”). By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Definitions & Applicability

2.1 Definitions

  1. Visitors – anyone browsing our website (ko-fi.tools).
  2. Creators – users embedding or calling our Widgets/API to fetch their Ko-fi data.
  3. Service – the website, JavaScript widgets, API, documentation, and all related features.
  4. Content – text, images, code samples, and any data provided through the Service.

2.2 Eligibility

You must be at least 18 years old to use any part of the Service, in line with Ko-fi’s requirements.

2.3 Changes to Terms

We may modify these Terms at any time, in our sole discretion. Updated Terms will be posted in our News section; your continued use of the Service after posting constitutes acceptance.

3. Website Use

3.1 License Grant

We grant Visitors a limited, non-exclusive, non-sublicensable, revocable license to access and use the website for personal, non-commercial purposes.

3.2 Restrictions

  1. Automated testing, AI training, or reverse-engineering of our site.
  2. Hacking, DDoS attacks, or interfering with site security or performance.
  3. Scraping the site for vulnerabilities or private areas.
  4. Any activity that violates applicable laws.

3.3 Availability & Disclaimer

The website is provided “as is” without SLA or uptime guarantee. We’re a one-person side project; availability may vary.

3.4 Termination

We may suspend or terminate any Visitor’s access for breach of these Terms, at our discretion, without notice.

4. JavaScript Widgets

4.1 License & Attribution

Widgets are licensed under GNU GPL v3.0. You must display “Powered by Ko-fi.tools” unless you’ve made a donation via Ko-fi.com.

4.2 Restrictions & Compatibility

  1. No fixed usage limits, but high-traffic sites that harm service stability may be banned after notice.
  2. Designed for modern browsers; backward compatibility is not guaranteed.
  3. Creators may not embed widgets in products for which end users are charged a fee.

4.3 Maintenance & Deprecation

We’ll provide at least 3 days’ notice before changes that break widget functionality. Deprecated versions remain for up to 1 month.

4.4 Content Restrictions

Creators with Ko-fi profile or banner images containing 18+ material may be banned, as such content is cached by our service.

5. API Service

5.1 Access & Referer Requirement

The API is open and requires no key, but every request must include a valid HTTP Referer header with your website’s address. Hidden or absent Referers may lead to suspension.

5.2 Rate Limits

Maximum 60 requests per minute. Exceeding this returns HTTP 429; persistent abuse may result in banning.

5.3 Data Accuracy & No Warranties

Data is scraped and cached; we make no guarantees as to accuracy, completeness, timeliness, or uptime.

5.4 Prohibited Commercial Use

Creators may not use the API to build products or services for which end users are charged fees.

5.5 Attribution

If you build tools with our API, please credit Ko-fi.tools in your “Credits” or feature footer, unless you’ve donated.

5.6 Termination for Abuse

High-traffic abuse, hidden Referers, or any activity impacting service stability may result in immediate suspension.

6. Intellectual Property & Feedback

6.1 Our Rights

All trademarks, logos, and service names are our property or licensed to us. You may not use them without permission.

6.2 Feedback

We welcome suggestions via our contact page, but have no obligation to implement or compensate you for ideas.

7. Disclaimers & Liability

7.1 Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied.

7.2 Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, even if advised of the possibility.

7.3 Indemnification

You agree to indemnify and hold us harmless from any claims arising out of your use or violation of these Terms.

8. Governing Law & General

8.1 Governing Law

These Terms are governed by Scottish law. Disputes fall under the exclusive jurisdiction of the Scottish courts.

8.2 Severability & Assignment

If any provision is unenforceable, the remainder stays in effect. You may not assign these Terms; we may assign them in connection with a sale.

8.3 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Service.
